Lindsay Clark was convicted of one misdemeanor count of violating the FDA Cosmetic Act in November. She admitted to sourcing misbranded drugs and devices. Additionally, her medical practice—Lindsay Clark, MD, Medical Corporation—pled guilty to the same crime, but as a felony. Prior to her conviction, Clark specialized in injectables. However, she has since admitted that from 2016 – 2020, she used various devices and Rx drugs that had not gone through the rigorous FDA licensing and approval processes. Additionally, it was found that she took measures to hide what she was doing from corporate distributors, the FDA, and patients.
Injection Issues
Clark sourced the products from outside the United States where the regulations surrounding drugs can be very different. She has been found guilty of buying unapproved, unlicensed Botox and hyaluronic acid (HA) fillers from various “online pharmacies,” then selling these products at a high profit to her patients. In total, Clark profited $1,069,880 from purchasing overseas products and flipping them in the U.S., all while telling her patients that they were legitimate and legal Botox and HA fillers.
The Principal Deputy Assistant Attorney General says “Consumers must have confidence that the prescription drugs and devices they use are authentic and safe … the Department of Justice will continue to work with its law enforcement partners to investigate and prosecute doctors who mislead patients for their own profit.” Clearly, injectors who illegally source, misbrand, and inject patients with adulterated prescription drugs are putting consumers at a high risk. Sentencing for Clark is scheduled for April 2023, and until that time she is no longer allowed to operate her practice or inject patients.
